This website is operated by European Performance Market LLC (“European Performance Market,” “EPM,” “we,” “us,” or “our”). Throughout the site, the terms “Services” and “Store” refer to this website and the related content, features, tools, products, and services made available through it.

European Performance Market is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service (“Terms”) govern your access to and use of the Store and any purchases made through it. By visiting, browsing, creating an account, placing an order, or otherwise using the Services, you agree to these Terms as well as our Privacy Policy, Shipping Policy, Refund Policy, and any other policies referenced on the Store.

If you do not agree to these Terms, you should not use the Services.

1. Eligibility and Accounts

By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence or otherwise have the legal capacity to enter into a binding agreement.

You agree to provide accurate, current, and complete information when creating an account, placing an order, or communicating with us.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

2. Products and Product Information

European Performance Market makes reasonable efforts to provide accurate product descriptions, specifications, photographs, pricing, compatibility information, and other product details. However, manufacturers may revise products, specifications, packaging, finishes, or other characteristics without notice.

Product images are provided for reference and may differ slightly from the product received because of manufacturer revisions, screen settings, lighting, finishes, or other factors.

We reserve the right to modify product information, discontinue products, limit quantities, or restrict the sale of products to particular customers, geographic regions, or jurisdictions where reasonably necessary.

3. Vehicle Fitment and Compatibility

While we strive to provide accurate vehicle compatibility and fitment information, customers are responsible for confirming that a product is suitable for their specific vehicle before purchase.

Vehicle year, model, chassis, engine, drivetrain, trim level, production date, existing modifications, and other factors may affect compatibility.

If you are uncertain about fitment, please contact European Performance Market before placing your order and provide your vehicle year, make, model, trim, engine, and any relevant modifications.

Installation, modification, or use of an incorrectly selected product may affect return eligibility as described in our Refund Policy.

4. Performance Parts, Installation, and Vehicle Use

Many products sold by European Performance Market are aftermarket performance or modification components. Modification of a vehicle may affect its operation, emissions compliance, manufacturer warranty, insurance coverage, noise levels, or suitability for public-road use.

Professional installation by a qualified technician is recommended where appropriate.

The customer is responsible for determining whether a product and its intended installation or use comply with all applicable federal, state, provincial, local, and international laws and regulations.

Certain products may be intended only for competition, racing, off-road, or other restricted uses where specifically stated. Products must not be installed or used in a manner prohibited by applicable law.

European Performance Market does not represent that every product offered through the Store is legal for road use in every jurisdiction.

5. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the products included in that order.

European Performance Market reserves the right to accept, decline, limit, or cancel an order where reasonably necessary, including because of product availability, pricing or listing errors, suspected fraud, payment issues, shipping restrictions, or other circumstances affecting fulfillment.

For eligible payment methods, your payment method may be authorized at checkout without being immediately captured. A payment authorization may appear as a pending transaction with your financial institution but does not necessarily mean that payment has been collected.

We may review an order and confirm product availability before capturing payment. A payment authorization alone does not constitute final acceptance or fulfillment of an order.

If an item is unexpectedly backordered or subject to a significant delay, we will make reasonable efforts to contact you before proceeding so that the available options can be discussed.

Please review your order carefully before submitting it. Once an order has been accepted, processed, or submitted for fulfillment, we cannot guarantee that cancellation or modification requests can be accommodated.

6. Product Availability and Backorders

We make reasonable efforts to maintain accurate product availability information. However, inventory and manufacturer availability may change without notice.

A product being available for purchase through the Store does not constitute a guarantee that it is physically available for immediate dispatch at the exact time an order is submitted.

If an item becomes unexpectedly unavailable or backordered, European Performance Market will make reasonable efforts to contact you with available information regarding the anticipated lead time and available options before proceeding where appropriate.

7. Pricing, Payment, and Billing

All prices are subject to change without notice.

The applicable product price will generally be the price displayed at the time the order is submitted, subject to correction of obvious pricing or listing errors.

Unless otherwise stated, product prices do not include shipping, taxes, duties, customs charges, brokerage charges, or other fees that may apply to the transaction.

You agree to provide current, complete, and accurate billing and payment information and represent that you are authorized to use the payment method provided.

We reserve the right to cancel an order where a material pricing, product, or technical error has occurred. If payment has already been captured for an order we cancel, any amount due to you will be returned in accordance with applicable law and our policies.

8. Shipping and Delivery

Orders are subject to processing before dispatch. Processing time and carrier transit time are separate, and estimated delivery times begin after an order has been processed and dispatched unless otherwise stated.

All delivery dates and transit times are estimates and are not guaranteed unless expressly stated otherwise.

Orders may be shipped from different fulfillment locations, and orders containing multiple products may arrive in separate shipments.

Shipping services, pricing, processing information, free-shipping eligibility, international delivery information, and other shipping terms are described in our Shipping Policy and at checkout.

European Performance Market is not responsible for delays caused by carriers, customs authorities, severe weather, transportation disruptions, holidays, force majeure events, or other circumstances outside our reasonable control.

9. International Orders

International shipping is available only to supported destinations and for eligible products.

Customers are responsible for complying with the import, automotive, emissions, safety, and other laws applicable in their destination country.

Depending on the destination and checkout service used, duties, taxes, customs charges, brokerage fees, or other import-related charges may either be collected at checkout or become payable separately.

Where such charges are not collected at checkout, they are generally the responsibility of the customer unless applicable law provides otherwise.

Customs inspections and import processing may delay delivery.

Nothing in these Terms limits any mandatory consumer rights provided by the laws applicable to an international customer.

10. Returns, Refunds, and Final-Sale Products

Returns, refunds, exchanges, final-sale restrictions, damaged or defective items, restocking fees, and return procedures are governed by our Refund Policy.

Products that have been installed, used, modified, altered, or damaged after delivery may not be eligible for return.

Certain products, brands, custom products, special-order products, clearance products, or other specified items may be final sale or subject to additional return restrictions.

Any mandatory statutory consumer rights that apply to a transaction take precedence over conflicting discretionary return restrictions.

11. Manufacturer Warranties

Certain products may be covered by a warranty provided by the original manufacturer.

Manufacturer warranties vary by brand and product and are subject to the applicable manufacturer's terms, conditions, exclusions, claim procedures, and eligibility requirements.

Unless expressly stated otherwise, European Performance Market does not provide a separate warranty beyond any rights provided by applicable law or an applicable manufacturer warranty.

We will reasonably assist customers with eligible manufacturer warranty matters where appropriate, but final warranty determinations may be made by the manufacturer.

Damage arising from improper installation, misuse, modification, racing, abuse, neglect, improper maintenance, or use outside the manufacturer's specifications may not be covered.

12. Errors, Inaccuracies, and Omissions

Occasionally, information on the Store may contain typographical errors, inaccuracies, or omissions relating to product descriptions, fitment, pricing, promotions, shipping charges, transit times, availability, specifications, or other information.

We reserve the right to correct such information and, where reasonably necessary, modify or cancel an affected order.

If a material error affects an order you have already placed, we will make reasonable efforts to contact you.

13. Intellectual Property

Unless otherwise indicated, the Store and its original content, design, graphics, text, logos, photographs, videos, layout, and other materials are owned by or licensed to European Performance Market and are protected by applicable intellectual-property laws.

You may access the Store for lawful personal use but may not reproduce, copy, modify, distribute, sell, republish, or commercially exploit our proprietary content without prior written permission.

Third-party manufacturer names, trademarks, logos, photographs, product descriptions, and other intellectual property remain the property of their respective owners.

References to vehicle manufacturers, models, product brands, and trademarks are used for identification, compatibility, and descriptive purposes. Unless expressly stated otherwise, such references do not imply sponsorship, affiliation, or endorsement by the applicable vehicle manufacturer or trademark owner.

14. Third-Party Tools and Services

The Store may provide access to tools, services, payment methods, financing options, applications, integrations, or functionality supplied by third parties.

Your use of third-party services may also be governed by the applicable third party's own terms and privacy policies.

To the fullest extent permitted by law, European Performance Market is not responsible for the operation, availability, accuracy, or independent conduct of third-party services outside our reasonable control.

15. Third-Party Links

The Services may contain links to websites, platforms, or resources operated by third parties.

We are not responsible for the content, security, privacy practices, accuracy, products, or services of third-party websites that are not controlled by European Performance Market.

You should review the applicable policies and terms of any third-party website before conducting a transaction with that party.

16. Relationship With Shopify

European Performance Market is powered by Shopify, which provides the ecommerce platform used to make the Services available.

Sales and purchases made through European Performance Market are transactions between you and European Performance Market, not Shopify.

To the fullest extent permitted by applicable law, Shopify is not responsible for products purchased from European Performance Market or for injury, damage, loss, refunds, returns, fulfillment, product performance, or other matters arising from transactions between you and European Performance Market.

Your use of certain Shopify features may also be subject to Shopify's applicable terms and privacy policies.

17. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Store is hosted by Shopify and uses third-party service providers, certain information may be processed by Shopify and other service providers as necessary to operate the Store, process payments, prevent fraud, fulfill orders, provide customer support, and perform other business functions.

18. Reviews, Feedback, and User Content

If you submit a review, photograph, testimonial, suggestion, comment, or other content to European Performance Market, you represent that you have the right to provide that content and that it does not violate applicable law or the rights of another person.

Unless otherwise agreed, you grant European Performance Market a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt such content for purposes reasonably related to operating, promoting, and improving the business and Services.

We may remove content that we reasonably determine to be unlawful, fraudulent, misleading, abusive, defamatory, infringing, or otherwise inappropriate.

You may use the Services only for lawful purposes.

You may not use the Services:

• for unlawful, fraudulent, abusive, or malicious purposes;
• to violate applicable laws or regulations;
• to infringe intellectual-property, privacy, or other legal rights;

We do not guarantee that the Store will always be uninterrupted, error-free, secure, or available at all times.

Except for warranties expressly provided by European Performance Market, an applicable manufacturer, or applicable law, we disclaim warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms excludes or limits any warranty, consumer right, or remedy that cannot lawfully be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, European Performance Market LLC and its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, revenue, data, use, or business opportunity, arising from or relating to your use of the Services or products purchased through the Store.

European Performance Market is not responsible for damage caused by improper installation, improper use, unauthorized modification, failure to follow manufacturer instructions, use of a product on an incompatible vehicle, or use contrary to applicable law.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless European Performance Market LLC and its affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, or reasonable legal expenses arising from your material breach of these Terms, violation of applicable law, or infringement of another party's rights.

23. Termination

We may suspend or terminate your access to the Services if we reasonably determine that you have materially violated these Terms, misused the Services, engaged in fraudulent conduct, or created a security or legal risk.

Any provisions that by their nature should survive termination will remain effective, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

24. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

25. Waiver and Entire Agreement

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

These Terms, together with the policies and terms incorporated by reference, constitute the agreement governing your use of the Services and supersede prior communications regarding the same subject matter.

26. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

European Performance Market may assign or transfer its rights or obligations in connection with a merger, acquisition, corporate reorganization, sale of assets, or other lawful business transaction.

27. Governing Law

These Terms and your use of the Services are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection laws require otherwise.

To the extent permitted by applicable law, disputes arising from these Terms or the Services will be subject to the jurisdiction of the appropriate state or federal courts located in Georgia.

Nothing in this section deprives a consumer of mandatory rights or protections available under applicable law.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, policies, or legal requirements.

The most current version will be posted on this page with the applicable “Last updated” date.

Where required by law, we will provide additional notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
